Legal Challenge Lodged Against US Stallion Cap

North American breeding news is highlighted today with news of a legal challenge lodged by three of the world’s biggest studs against The Jockey Club's new rule to restrict thoroughbred stallions foaled from 2020 onwards covering more than 140 mares each year.

The complaint against the “stallion cap”, was filed in the U.S. District Court Eastern District of Kentucky, Central Division in Lexington, names The Jockey Club, Kentucky Horse Racing Commission chairman Jonathan Rabinowitz, and KHRC executive director Marc Guilfoil as defendants.


The suit has been brought by Spendthrift Farm, Ashford Stud (Coolmore US) and Three Chimneys Farm, and argues KHRC has unlawfully delegated power to The Jockey Club, and that the new rule breaches the constitutions of Kentucky and the United States as well as federal and state antitrust laws.
